Terms of Service

1. The Service

ContactCTL ("the Service") is a credit-based command-line tool and HTTPS API for finding, verifying, and enriching B2B contact data. It is operated by Miha Cacic s.p., a sole proprietor registered in Slovenia, European Union ("we", "us"). By creating an account or using the Service you accept these terms. The Service is built for professional use; if you accept these terms on behalf of a company, you confirm you may bind it.

2. Accounts and API keys

You need an account and an API key to use the Service. Keep your credentials and API keys confidential: everything done with your keys counts as done by you, including credit spend. If a key leaks, revoke it in the dashboard immediately — revocation is instant. You must provide accurate account information and be at least 18 years old.

3. Plans, billing, and renewal

Subscriptions are priced in EUR and billed monthly through our payment processor (Stripe). There is no free trial and there are no yearly plans. The plans:

Subscriptions renew automatically each month until cancelled. You can cancel anytime from the dashboard; cancellation takes effect at the end of the current billing period, and you keep full access until then. Upgrades and downgrades take effect per the dashboard flow and are prorated by the payment processor where applicable.

4. Plan credits

Each plan grants a monthly credit allowance. Plan credits reset at every renewal and do not roll over — unused plan credits expire at the end of each billing period. Credit costs per action are published on the pricing page and in the documentation; the cost in effect when you run an action is the cost you are charged.

Charge semantics: find, phone, and whois charge only when a result is found. A clean miss costs nothing. Verification is charged per verification, searches per request, and lookalikes per returned row.

5. Top-up credits, cancellation, and parking

• Top-ups are one-time credit purchases at your active plan's rate, with a minimum purchase of €5.
• Top-up credits never expire while a subscription is active and survive plan changes.
• Plan credits are spent first, then top-up credits, oldest first.
• If you cancel, remaining plan credits end with the billing period, and unused top-up credits are parked: unusable without an active subscription, held for 12 months from the date your subscription ended. Resubscribing within that window un-parks them in full and clears the countdown. After 12 months they are forfeited.

6. Refunds and right of withdrawal

Spent credits are not refundable. Subscription fees for a billing period that has started are not refundable, except where the law requires otherwise. Because the Service delivers digital content immediately on purchase, consumers in the EU expressly consent to immediate performance and acknowledge that the 14-day right of withdrawal is lost once credits from a purchase are spent. If we terminate your account without cause, we refund unused top-up credits at their purchase rate.

7. Price changes

We may change plan prices, credit allowances, or per-action credit costs with at least 30 days' notice by email. Changes apply from your next billing period after the notice period. If you do not agree, cancel before the change takes effect; continued use after that date means you accept the new prices.

8. Acceptable use

You must not use the Service to:

• send spam or unsolicited communications in breach of applicable anti-spam or data-protection law (GDPR, ePrivacy rules, CAN-SPAM, or their local equivalents);
• facilitate scraping — including using the Service as part of a pipeline that scrapes or automates websites or social networks in breach of their terms;
• resell, sublicense, or redistribute raw data exports as a database or data product — results are licensed for your own business use, not for republication;
• circumvent credit metering, rate limits, or account boundaries (including sharing one account across organizations);
• look up individuals for harassment, surveillance, or any unlawful purpose.

We may suspend or terminate accounts that violate this section (see section 13).

9. Your data responsibilities

For the lookup inputs you submit and the results you export, you act as an independent data controller. You are responsible for having a lawful basis for your enrichment and outreach and for honoring objections and suppression requests from your recipients. How we handle data on our side is described in the Privacy Policy.

10. Fair use and rate limits

API keys are rate-limited per key. Limits are published in the documentation and exist to keep the Service fast for everyone. Failed lookups are free but logged; we may throttle or suspend usage patterns that probe the Service at abusive volume, and we will contact you before suspending unless the pattern is clearly malicious.

11. Availability and warranties

The Service is provided "as is" and "as available", without warranty of uptime, fitness for a particular purpose, or completeness of results. Contact data comes from third-party sources and the real world; we do not warrant that any lookup returns a result or that every returned result is accurate — which is why misses are free and verification is part of the product. We may modify or discontinue features with reasonable notice for material changes.

12. Limitation of liability

To the extent permitted by law, our total liability for all claims arising out of or relating to the Service is capped at the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect or consequential damages, lost profits, or lost data. Nothing in these terms excludes liability that cannot be excluded by law, including liability for intent or gross negligence.

13. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your account for material breach of these terms — for acceptable-use violations, effective immediately; otherwise with 14 days' notice and a chance to cure. On termination, plan credits end with the billing period and top-up credits follow the parking rules in section 5, except that credits are forfeited immediately on termination for material breach.

14. Governing law and disputes

These terms are governed by the law of the Republic of Slovenia. The courts of Ljubljana, Slovenia have exclusive jurisdiction, except that consumers in the EU keep the protections and venue rights of their country of residence.

15. Changes to these terms

We may update these terms. For material changes we give at least 14 days' notice by email before they take effect (30 days for price changes, per section 7). Continued use after the effective date means acceptance. The current version, with its effective date, always lives at this URL.
